Terms and Conditions
These Terms and Conditions apply to the facilitation of ticket purchases and the purchase of value vouchers through Klangquelle for buyers via the registration form, by phone, and via email. The Terms and Conditions are valid in the version applicable at the time of registration or order.
1. Scope and General Provisions
Liegekonzerte facilitates the purchase of tickets for time-bound events on behalf and for the account of Klangquelle through the registration form, email, and telephone. All claims of any kind related to the event must be directed exclusively to the respective organizer. The data and information about events provided on the website and in communications serve as preliminary information for interested parties about the events. By placing an order, the attendee confirms that, based on the available information (Liegekonzerte website, www.liegekonzerte.at, and any linked information provided by the organizer), they have informed themselves prior to purchasing the ticket about the location, nature of the event, program, time, and duration of the event and that the event is suitable for their purposes.
Wert-Gutscheine werden über einen bestimmten Wert in der beschriebenen Euro-Staffelung angeboten und können für den Kauf von Veranstaltungstickets oder Dienstleistungen eingelöst werden.
2. Order
When purchasing via the order form, the customer has the opportunity to review their order and correct any errors before submitting their declaration by clicking the button. All orders placed by the customer are binding as soon as they purchase tickets or value vouchers via the registration form by clicking the “Buy Now” button or otherwise declare their intent to purchase. For electronic purchases, the customer will receive a separate, automated confirmation of receipt of their order via the medium used after the order is received. Such a confirmation of receipt does not yet constitute acceptance of the offer by the organizer in the case of ticket orders or value voucher purchases. Acceptance is only made through a separate written order confirmation, the sending of an invoice, or the actual delivery of the ordered tickets, vouchers, or goods within the agreed delivery period.
Payment
The listed prices are final consumer prices. Depending on availability, payment can be made via bank transfer or in cash on-site. The charged amount consists of the price of the ticket(s) (including any applicable sales fees), the handling fee, the voucher value or goods value, as well as any shipping, deposit, or other fees according to the current price list. All price components are displayed to the buyer before placing a binding order. Each ticket is only valid upon full payment.
4. Organizer's House Rules
By purchasing a ticket, the attendee agrees to comply with the house rules of the respective venue as well as the instructions of the organizer. For all venues, the entry policy of the respective venue applies to latecomers. The ticket is invalid if torn or detached.
Cancellation / Changes to the Event, Refunds
As a voluntary service, Klangquelle reserves the right to notify customers who have purchased tickets for an event electronically via email in the event of a cancellation, postponement, or any other change to the event, provided the relevant contact details are available.
6. Validity, Redemption, Transferability, and Prohibition of Commercial Resale of Vouchers
Value vouchers are valid for a period of 1 years from the date of contract conclusion. The issue date indicated on the voucher is decisive.
Die Barablöse ist ausgeschlossen.
7. Right of Withdrawal
7.1 Exclusion of the Right of Withdrawal
The customer generally has the right to withdraw from this contract within fourteen days without providing any reason. However, the right of withdrawal does not apply in the following cases:
There is no right of withdrawal when purchasing tickets for a specific event! Services related to leisure activities, where a specific date or period for the fulfillment of the contract is contractually agreed upon by the organizer, are excluded from the right of withdrawal pursuant to § 18 Abs 1 Z 10 FAGG. Therefore, the consumer has no right to withdraw from the mediated purchase contract for the tickets.
For value vouchers: When purchasing value vouchers, the customer has the right to withdraw from the contract within fourteen days of its conclusion without providing any reason, unless the right of withdrawal expires earlier.
The customer has no right of withdrawal if they redeem the value voucher within the withdrawal period and, in return, receive an event ticket for a specific date. Additionally, if the service is fully provided before the end of the withdrawal period—based on the customer’s explicit request for early fulfillment of the service and their acknowledgment of the loss of the right of withdrawal upon complete fulfillment of the contract—the right of withdrawal is forfeited.
Sofern der Kunde ein Widerrufsrecht hat, sind folgende Bestimmungen anwendbar:
Die Widerrufsfrist beim Erwerb von Wert-Gutscheinen beträgt, so es nicht gemäß Pkt 7.1 ausgeschlossen ist, vierzehn Tage ab dem Tag des Vertragsabschlusses
Um das Widerrufsrecht auszuüben, muss der Kunde mich (Klangquelle, Grubbachstraße 14, 4644 Scharnstein, kontakt@klangquelle.at) mittels einer eindeutigen Erklärung (zB ein mit der Post versandter Brie oder E-Mail) über seinen Entschluss, den vermittelten Kaufvertrag zu widerrufen, informieren. Zur Wahrung der Widerrufsfrist reicht es aus, dass der Kunde die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absendet.
7.2 Consequences of Withdrawal
If the customer exercises an existing right of withdrawal effectively, we will refund all payments received from them, including any delivery costs, without delay and no later than fourteen days from the day we receive the notification of withdrawal from the purchase contract. For this refund, we will use the same payment method that the customer used in the original transaction, unless expressly agreed otherwise with the customer; in no case will fees be charged to the customer for this refund.
In the event of a withdrawal, the customer must return or hand over the goods to me, Klangquelle, Grubbachstraße 14, 4644 Scharnstein, Austria, no later than fourteen days from the day they inform me of their withdrawal from this contract. The deadline is met if the customer dispatches the goods before the fourteen-day period expires.
However, the customer bears the costs of returning the goods.
I may withhold the refund for vouchers until I have received the vouchers back or until the customer has provided proof that they have returned the vouchers.
